Consumer Bankruptcy

Bankruptcy Lawyer in Eastern Minnesota and Western Wisconsin

Chapter 7 Bankruptcy ◊ Chapter 13 Bankruptcy

If you are struggling to meet your financial obligations, the federal bankruptcy laws can provide relief and help you get a fresh start. Whether you file under Chapter 7 or Chapter 13, you will immediately be protected by an automatic stay, which prevents creditors from calling, sending letters or taking legal action against you (outside of the bankruptcy proceeding).

At St. Croix Mediation and Family Law Center, in Oakdale, attorney Gregory P. Seamon provides comprehensive counsel in personal bankruptcy matters. The firm represents clients throughout eastern Minnesota and western Wisconsin, including Woodbury and Hudson. With 25 years of experience, attorney Seamon knows how to get you the results you need.

For a free initial consultation, contact the firm online or call 651-315-7935 (toll-free at 888-310-6141) to set up an appointment.

Discharge Your Debts with a Chapter 7 Bankruptcy Filing

Under Chapter 7, you are allowed to liquidate or permanently discharge certain unsecured debt obligations. You must now qualify for protection under Chapter 7 by demonstrating to the bankruptcy court that you lack the means to repay your creditors over a 3 to 5 year period.

When you hire St. Croix Mediation and Family Law Services to handle your personal bankruptcy, attorney Seamon will walk you through the means test to determine whether you are eligible for a Chapter 7 bankruptcy. If so, the firm will prepare and file all documents required to complete your Chapter 7 bankruptcy and will act as your representative in meetings or hearings with creditors or the bankruptcy trustee. Attorney Seamon will make certain you understand which debts can and cannot be discharged before you file, so that you get the expected benefit. The firm will also oversee the sale of your property to ensure that exempt assets are excluded.

Reorganization under Chapter 13 Bankruptcy

If you fail to qualify for protection under Chapter 7 or you want to pay your creditors back, you can file for reorganization or restructuring of your debt under Chapter 13. In this process, you enter into agreements to repay your creditors over a 3 to 5 year period.

If you seek protection under Chapter 13, attorney Seamon will prepare and file all the paperwork to complete the process. The firm will also help you put together a plan of reorganization to submit to your creditors and will review any proposed repayment plans you receive, to ensure that they are in your best interests.
